Terms of Service

By accessing or using Gift Buddy (the mobile application and the website at giftbuddy.me), you agree to be bound by these Terms of Service. If you do not agree, do not use the app or website.

Gift Buddy is a cross-platform gift coordination app available on iOS, Android, and the web. The service provides: - Creating and managing gift wishlists with titles, descriptions, prices, links, and categories - Sharing wishlists with friends and family - Following other users and viewing their wishlists in a live feed - Claiming and fulfilling gifts from others' wishlists - Managing your personal profile with customizable settings

Gift Buddy offers both free and premium tiers: Free Tier: - All core features are available at no cost, including wishlist creation, sharing, following users, gift fulfillment tracking, and profile management. Gift Buddy Premium: - Premium subscriptions unlock additional features as described in the app. The specific features, pricing, and availability of premium plans may change over time. - Free features will remain available to all users regardless of subscription status.

If you subscribe to Gift Buddy Premium: Billing: - Subscriptions purchased through the mobile app are billed through the Apple App Store or Google Play Store, depending on your platform. Payment is charged to your app store account at confirmation of purchase. - Subscription prices are displayed before purchase and include applicable taxes. Auto-Renewal: - Subscriptions automatically renew at the end of each billing period (monthly, semi-annual, or annual) unless canceled before the renewal date. - For app store subscriptions: cancellation must occur at least 24 hours before the end of the current period. Cancellation: - App store subscriptions: cancel through your Apple App Store or Google Play Store account settings. - Cancellation takes effect at the end of the current billing period. You will retain access to premium features until the period expires. - Deleting the app does not cancel your subscription — you must cancel through your app store account settings. Price Changes: - We may change subscription prices at any time. Price changes take effect at the start of the next billing period after notice is provided. - If you do not agree with a price change, you may cancel your subscription before the new price takes effect. EU Right of Withdrawal: - Under EU consumer law, you have a 14-day right of withdrawal from the date of purchase. By subscribing, you acknowledge that digital content delivery begins immediately. You may still request a refund within 14 days in accordance with our Refund Policy. Free Trials: - If a free trial is offered, it converts to a paid subscription at the end of the trial period unless canceled before the trial ends.

- You must be at least 13 years old to use the service - You must provide accurate information during registration - You are responsible for maintaining the security of your account - You must not share your account credentials - One person may only maintain one account

You agree not to: - Use the service for any illegal purpose - Harass, abuse, or harm other users - Upload harmful, offensive, or malicious content - Attempt to gain unauthorized access to other accounts - Use the service for commercial spam, advertising, or fraud - Interfere with or disrupt the proper functioning of the service - Scrape, crawl, or use automated means to access the service without permission - Share, resell, or transfer your subscription to another user

- You retain ownership of content you create (gift lists, profile information) - You grant us a non-exclusive, worldwide license to display your content within the app to facilitate the service - You are responsible for the accuracy and legality of your content - We may remove content that violates these terms without prior notice

- The Gift Buddy app, website, design, and underlying code are our intellectual property - You may not copy, modify, reverse-engineer, or distribute any part of the service - The Gift Buddy name, logo, and branding are our trademarks

Gift links in wishlists may direct to external websites and online stores. Subscriptions are processed through Apple or Google depending on your platform. We are not responsible for the content, privacy practices, or availability of third-party websites and services. Any purchases made through external links are solely between you and the third-party seller.

The service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee uninterrupted, error-free, or secure service. We make no warranties regarding the accuracy or reliability of any content shared by users. Premium features are subject to availability and may be modified or discontinued.

To the maximum extent permitted by applicable law, we are not liable for any indirect, incidental, special, or consequential damages arising from your use of or inability to use the service, including but not limited to loss of data, lost profits, or damages resulting from gift coordination. Our total liability for any claim related to the service shall not exceed the amount you paid us in the 12 months preceding the claim.

You agree to indemnify and hold harmless Gift Buddy and its team from any claims, damages, or expenses arising from your use of the service, your content, or your violation of these terms.

We may terminate or suspend your account at any time for violation of these terms or for any reason with reasonable notice. You may delete your account at any time through the app settings. Upon termination, your data will be deleted in accordance with our Privacy Policy. Active subscriptions must be canceled separately through the Apple App Store or Google Play Store — account deletion does not automatically cancel billing.

These terms are governed by applicable law. Any disputes will be resolved through appropriate legal channels in the jurisdiction where Gift Buddy operates. If you are a consumer in the EU, you retain rights under the consumer protection laws of your country of residence.

We may modify these terms at any time. We will notify users of significant changes through the app or via email at least 30 days before the changes take effect. Continued use of the service after changes take effect constitutes acceptance of the modified terms. If you disagree with the changes, you may cancel your subscription and stop using the service.
